Welcome to TravelMate. These Terms of Service ("Terms") govern your access to and use of the TravelMate mobile application ("App," "Service," or "TravelMate"). By downloading, installing, or using TravelMate, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.
1. Acceptance of Terms
By creating an account or using TravelMate, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and TravelMate.
If you are using TravelMate on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old to use TravelMate. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent and warrant that:
- You meet the age requirements stated above
- You have the legal capacity to enter into these Terms
- You are not prohibited from using the Service under applicable laws
3. Description of Service
TravelMate is an AI-powered trip planning application that provides:
- Automated trip itinerary generation using artificial intelligence (Claude API and Google Gemini)
- Interactive AI chat consultation for trip customization
- Activity scheduling with calendar and map visualization
- Multi-trip management with cloud synchronization
- Offline access to saved trips
- Integration with Google Maps for location services
TravelMate uses artificial intelligence to generate trip recommendations. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or outdated information. This includes but is not limited to:
- Incorrect business operating hours or closure days
- Inaccurate location addresses or GPS coordinates
- Outdated pricing information
- Closed, relocated, or non-existent venues
- Inappropriate activity recommendations
- Geographic errors or impossible travel routes
- Cultural or safety misunderstandings
You are solely responsible for verifying all information before making travel decisions. TravelMate is a planning tool only and should not be your sole source of travel information.
4. User Accounts and Responsibilities
4.1 Account Creation
To use TravelMate, you must create an account with a valid email address and password. You agree to:
- Provide accurate and complete registration information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities under your account
4.2 Account Security
We recommend against jailbreaking (iOS) or rooting (Android) your device, as this may compromise security features and prevent TravelMate from functioning properly. We are not responsible for security breaches resulting from modified devices.
4.3 Prohibited Conduct
You agree NOT to:
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Create derivative works or modify the App
- Use the App for any illegal, harmful, or fraudulent purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Transmit viruses, malware, or harmful code
- Harass, abuse, or harm other users
- Scrape or data mine the App without permission
- Impersonate any person or entity
- Interfere with or disrupt the App's operation
- Use automated systems (bots) to access the Service
5. Intellectual Property Rights
5.1 Our Intellectual Property
TravelMate, including its design, features, text, graphics, logos, and software, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.
5.2 Your Content
You retain ownership of the trip itineraries and data you create in TravelMate. By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely to provide the Service to you.
5.3 AI-Generated Content
Trip itineraries generated by our AI services are provided to you for your personal use. While we facilitate the generation of this content, the underlying AI models are provided by third parties (Anthropic Claude, Google Gemini), and certain intellectual property considerations may apply.
6. Limitation of Liability and Disclaimers
PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS OUR LIABILITY TO YOU.
6.1 No Warranty on AI Accuracy
TravelMate is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We specifically disclaim all warranties regarding:
- The accuracy, completeness, or reliability of AI-generated trip recommendations
- The correctness of business hours, locations, prices, or availability
- The suitability of recommended activities for your specific needs
- The safety or accessibility of suggested locations
- Uninterrupted or error-free operation of the App
- The security of data transmission or storage
6.2 No Travel Guarantees
TravelMate is a planning tool only. We do NOT:
- Make travel bookings or reservations on your behalf
- Guarantee the availability of venues, activities, or services
- Guarantee the accuracy of suggested travel routes or timings
- Provide travel insurance or protection
- Assume responsibility for travel-related issues or disruptions
6.3 User Responsibility to Verify Information
YOU ARE SOLELY RESPONSIBLE FOR:
- Verifying all business hours, locations, and prices before visiting
- Confirming the existence and operation of recommended venues
- Researching safety, visa, and health requirements for your destinations
- Making reservations and bookings independently
- Ensuring activities are appropriate for your group's abilities and interests
- Complying with local laws and regulations
- Obtaining appropriate travel insurance
6.4 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVELMATE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Travel expenses, accommodations, or related costs
- Personal injury or property damage arising from use of AI-generated recommendations
- Damages resulting from reliance on AI-generated information
- Losses due to app downtime, errors, or data loss
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS LESS.
6.5 Third-Party Services
TravelMate integrates with third-party services including:
These third-party services have their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of these third-party services. Your use of these services is at your own risk.
7. Internet Connectivity and Data Usage
TravelMate requires an internet connection for certain features including:
- AI trip generation and chat consultation

- Map loading and location services
- Real-time updates and notifications
While offline access is available for saved trips, you are responsible for:
- Data charges from your mobile carrier
- International roaming fees if applicable
- Ensuring adequate internet connectivity
We are not responsible for additional charges incurred from your carrier or for app malfunction due to poor connectivity.
8. Fees and Payment
8.1 Current Pricing
TravelMate is currently offered free of charge. However, we reserve the right to introduce paid features, subscriptions, or in-app purchases in the future.
8.2 Future Changes
We may modify our pricing structure at any time. If we introduce fees for previously free features, we will:
- Provide advance notice through the App or email
- Clearly communicate what features require payment
- Allow you to opt-out or cancel before charges apply
9. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

- Your trip data is stored in Firebase Cloud Firestore
- AI processing requires sending trip preferences to third-party AI providers
- You can delete your account and data at any time
- We implement security measures to protect your data
10. Updates and Modifications
10.1 App Updates
We may release updates to TravelMate from time to time to:
- Add new features or improve existing ones
- Fix bugs and improve performance
- Enhance security
- Comply with platform requirements (iOS, Android)
You are responsible for downloading and installing updates. Some features may require the latest version of the App. We do not guarantee support for outdated versions.
10.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of TravelMate at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
11. Termination
11.1 Termination by You
You may stop using TravelMate and delete your account at any time through the App settings or by contacting us.
11.2 Termination by Us
We reserve the right to suspend or terminate your account and access to TravelMate at our discretion if:
- You violate these Terms or our policies
- Your account is inactive for an extended period
- We are required to do so by law
- Continued operation would create security or legal risks
11.3 Effect of Termination
Upon termination:
- Your right to use the App immediately ceases
- You must delete the App from your device
- Your data may be deleted from our servers within 30 days
- Certain provisions of these Terms survive termination (liability limitations, dispute resolution, etc.)
12. Indemnification
You agree to indemnify, defend, and hold harmless TravelMate and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any rights of third parties
- Your reliance on AI-generated information
- Travel-related incidents or losses
13. Dispute Resolution and Governing Law
13.1 Informal Resolution
Before filing a legal claim, you agree to first contact us at pivotmasterapps@gmail.com to attempt to resolve the dispute informally.
13.2 Arbitration Agreement
Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration rather than in court, except where prohibited by law. Arbitration is more informal than a lawsuit and uses a neutral arbitrator instead of a judge or jury.
13.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

14.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
14.5 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet service failures.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify you through the App or via email for material changes
- Provide you with an opportunity to review the changes
Your continued use of TravelMate after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and delete your account.
